Window manufacturer issue
I’m dealing with a window manufacturer and I have a problem. I paid my deposit to start shop drawings. They did the shop drawings but one of the sliding doors they can’t make it in 2 panels like I had on my drawings, they say they have to do it in 3 sections. The proposal says non refundable and there is a paragraph on the proposal stating that tenders are subject to evaluation by the window manufacturers technical department.
I want my money back so I can go elsewhere. I didn’t sign anything but they have my deposit and have done the shop drawings. Do I have any chance of getting my money back?
also, should it have been my or my architects responsibility to confirm for certain they could do the exact design I had before I paid a deposit ?

If their proposal says non-refundable then that's what it is, but if they are reasonable or don't want bad reviews they should return at least some of your deposit, perhaps minus time spent on drawings. While ideally architects and designers would understand manufacturers' limitations, there are a lot of companies out there, each with multiple product lines with their own standards and things change over time. It's very hard to keep up unless you only specify one or two brands. A change from two panels to three panels is a reasonable compromise in most cases. I would call the window rep and explain your concerns.
